Apple and Epic Games return to court to argue over App Store rules

Apple and Epic Games return to court to argue over App Store rulesMon, Nov 14, 2022 12:44 pm PST, Julie Clover

The legal battle between Apple and Epic Games resumed today, with lawyers from both companies meeting in United States. The Court of Appeals will attempt to overturn last year's original decision.

‌Epic Games‌ The saga against Apple began back in 2020 when ‌Epic Games‌ began allowing Fortnite players to make in-app purchases, bypassing in-app purchase rules. Apple quickly removed the Fortnite app from the App Store and ‌Epic Games‌ was ready to file an antitrust lawsuit against the ‌App Store‌ rules.

‌Epic Games‌ sought permission from the court to use third-party app stores and alternative methods for obtaining apps on iOS devices, but ‌Epic Games‌ largely lost the lawsuit, which led to an appeal. Apple won an antitrust lawsuit, but was ordered to allow developers to link apps to third-party websites where they can accept payments.

Apple doesn't want to change its ‌App Store‌ rules, and also filed an appeal, leading to today's trial. Epic Games will argue that the court made “many legal errors” in its original decision, once again arguing for permission to download unpublished material.

Apple says ‌Epic Games‌ lost the trial due to “unprecedented” and “unsubstantiated” allegations of anti-competitive behavior that ultimately did not affect the judge. Epic has made far-reaching antitrust claims, according to Apple, and there is no reason to overturn the decision on appeal. Apple will also argue that the original court erred in applying the injunction, which would force the ‌App Store‌ changes.

Apple states that because no anti-competitive behavior has been found, ‌App Store‌ the rules are not unfair, and the district court did not have the power to issue an injunction.

‌Epic Games‌ The appeal against Apple will begin at the U.S. Court of Appeals for the Ninth Circuit at 2:00 p.m. Pacific time zone. The appeal is streamed live on YouTube for those interested in watching.
